The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements:  "Client", “You” and “Your” refers to you, the person accessing this website and accepting UT Arms terms and conditions.  "The Company", “Ourselves”, “We” and "Us", refers to UT Arms.  “Party”, “Parties”, or “Us”, refers to both the Client and UT Arms, or either the Client or UT Arms. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of UT Arms stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

DISCLAIMER

Exclusions and Limitations

The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, UT Arms:

• Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or UT  Arms literature; and
• Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised UT Arms of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

Payment

Visa, Master Card, Discover and Good old Green Backs are all acceptable methods of payment.  Our Terms are payment in full when you submit payment on this website.  All goods remain the property of UT Arms until paid for in full.  We reserve the right to seek recovery of any remaining balance unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court.  In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Cancellation Policy

We process orders as quickly as we can.  If we receive a cancelation request before your order is shipped we will process the cancelation, otherwise your order will not be canceled.  We run a batch update nightly for orders processed, so your order may not show shipped on our website even though it is shipped.  We will notify you via email if your cancelation request was processed or not.

Availability

Products and services featured on this website are only available within the United States.  All advertising is intended solely for the United States market.  Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of UT Arms.  UT Arms does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify UT Arms, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Shipping costs and Delivery

We will cover cost of standard shipping of all firearms to your designated FFL in your state of residence.  We ship either UPS or USPS Priority mail.  If you require expedited shipping it will be charged according to your request.  There may be additional cost to ship guns to Alaska or Hawaii.  We do not ship to the below states so please know your local and state requirements before purchasing as we do charge a 20% restocking fee and returned shipping costs.  All firearms should ship in 3-7 working days after receipt of payment and all required documents (FFL) for shipping. All other items ship within 3-7 days after payment is received. We will not be responsible for transfer fees between you and your dealer.  You will not pay UT ARMS for the transfer fee.   

Returns

Returns are only accepted without restocking fee if merchandise is found defective immediately upon receipt of the product or before it is transfered into your possesion.  We do not cover refunds for Buyers Remorse or if you find a different one.  Please inspect all firearms at your FFL before transfering the firearm into your name.  Once the firearm has been transfered to you it is now a USED firearm.  If you do find the firearm to be defective or does not work after you have transfered the firearm from the FFL.  You can contact the manufacturer of the firearm and send the firearm directly back to them for repair. You can send the firearm directly to the manufacturer to avoid any kind of transfer fee as they can send your repaired firearm back to you with out going through an FFL.  However, if the manufacturer chooses to replace the firearm, the replacement firearm must transfer to your local FFL dealer to document the replacement firearm serial number.

Log Files

We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use.  IP addresses are not linked to personally identifiable information.  Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL.  This information is not shared with third parties and is used only within UT Arms on a need-to-know basis.  Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Like most interactive web sites this website uses cookies to enable us to retrieve user details for each visit.  Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting.  Some of our affiliate partners may also use cookies.

Product Images

Manufactures have the right to change their product packaging without notification, and we do our best to keep product images up to date.  Most of the time distributors do not know packaging has changed until it is received.  We guarantee you will receive the product purchased regardless of packaging.  Product packaging will not be considered a misrepresentation of the actual product contained within the packaging.

• I assume full responsibility for any hazardous effects from handling/discharging ammunition.
